Markets slump on disappointing earnings from IBM & Intel

Markets were under water all day.  Dow lost 82 (closing near the lows), decliners over advancers 2-1 & NAZ fell 11.  The Financial Index dropped 1+ to the 206s, the bulls would say nothing serious.  The MLP index was up fractionally in the 389s & but the REIT index fell 1+ to the 252s (remaining near its yearly highs in the 255s).  Junk bond funds drifted lowed while Treasuries had a modest advance, bringing the yield on the 10 year Treasury below 2%.  Crude fell for the first time in 3 days on an Energy Dept report showing a larger- than-expected supply gain.  Gold ended lower, as physical demand was seen as lacking, the lowest settlement in 2 weeks.

Obama Issues First Pollution Rules for Gas Wells

The administration is issuing the first national standards to control air pollution from gas wells that are drilled using a method called hydraulic fracturing, or fracking, but not without making concessions to the oil & gas industry.  Obama has strongly backed natural gas drilling as a clean energy source, & recently announced an executive order calling for coordination of federal regulation to ease burdens on producers.  But he has come under criticism for policies that may discourage energy development.  Much of the air pollution from fracked gas wells is vented when the well transitions from drilling to actual production, a 3-10-day process which is referred to as "completion."  An earlier version of the rule limiting air pollution from gas wells would have required companies to install pollution-reducing equipment immediately after the rule was finalized.  Now drillers would be given an additional 2 years to employ technology to reduce emissions of smog- and soot-forming pollutants during that stage.  The EPA will require drillers to burn off gas in the meantime, an alternative that can release smog-forming nitrogen oxides, but will still reduce overall emissions.  Industry groups had pushed for the delay, saying the equipment to reduce pollution at the wellhead during completion was not readily available.  About 20K wells a year are being fracked, a process where water, chemicals & sand are injected at high pressure underground to release trapped natural gas.  "We believe that industry was correct in that we needed to have a ramp-up period," an administration official said.  This is "new" technology used for getting more oil & gas, especially in the US.  Many MLPs are investing large sums in this technology.

Pfizer Said to Pick Nutrition Buyer as Soon as Next Week

Pfizer, a Dow stock, may select a buyer for its infant-nutrition unit as soon as next week after receiving bids from Nestle & Danone.  Each has submitted final offers of about $10B.  Other consumer companies & private-equity firms are also involved in the auction because they may alleviate the antitrust risk for the bidders.  Danone & Nestle have been working on ways to overcome antitrust hurdles since Feb when Nestle was considering buying all of the infant-nutrition assets & then conducting an auction to sell what it can’t keep because of regulatory concerns it would become too dominant in some markets.  Either way, PFE will be receiving money it can use to purchase other companies.  PFE was up 14¢.

Yahoo reported Q1 sales that topped estimates, fueling optimism that a turnaround may take hold.  Revenue, excluding sales passed on to partner sites, rose 1% to $1.08B, slightly ahead of the $1.06B predicted & the first increase since Q3 of 2008.  YHOO benefited from growth in the US online-ad market, which grew 23% as corps devoted more marketing dollars to the internet.  Since CEO Thompson took over in Jan, job cuts were announced & there has been a reorganization to lift profit, reverse a sales slump & lure back users lost to the competition.  Sales & profit this qtr may also exceed estimates with revenue of $1.03B-$1.14B, YHOO said & compares with a $1.08B forecast.  Income from operations in Q2 will be $115M-$195M, YHOO said & compares with the average forecast of $164M forecast.  Search-advertising revenue, excluding sales passed on to partners, increased 8% to $384M, compared with a 4% decline for display, the category that includes banners, boxes & videos adorning Web pages.  The sign in the picture summarizes the chart for Yahoo in recent years.  But today, it was up 48¢.

After gaining almost 300 in 2 days, Dow & the rest of the market were entitled to take a rest.  Earnings have been powering the market moves in both directions.  So far, earnings are getting mixed reactions but Dow is down almost 200 in Apr.  MLPs were clearly market leaders off the lows in early 2009, but this year have been lagging behind.  YTD, the index is about even while Dow is up a solid 800.  New rules for fracking may remove some uncertainties about their businesses.  Back to Dow, it broke thru 13K convincingly more than a month ago but since then has gone nowhere.  The first wave of earnings reports have not been a help & earnings season may continue to be challenging for stocks.

European debt crisis worries grow, taking markets lower

After staging a recovery from early losses, stocks sank in the last hour.  Dow finished down 190, decliners over advancers 3-1 & NAZ was 46 lower.  Bank stocks suffered a similar fate, with major selling in the last hour of trading. 

The MLP index fell 1 to 366 & the REIT index was off 2 to 223.  Junk bond funds were mixed & Treasuries were higher on growing unrest in the European debt mess.  Oil climbed solidly above $100 a barrel, the first time since Jul.  Gold continued to fluctuate in the the mid 1700s where it has been all week.

A Dem on the "supercommittee" questioned whether Reps are still interested in negotiating after the panel's top GOP member said Reps have "gone as far as we feel we can go" on tax hikes.  A sense of deep pessimism has gripped the supercommittee, & judging from the limited public statement by panel members, a debt bargain could be out of reach.  "We need to find out whether our Republican colleagues want to continue to negotiate or whether they've drawn a hard line in the sand," said supercommittee Dem Chris Van Hollen of Maryland. "The question is whether they've kind of said 'take it or leave it.' "  Yesterday Jeb Hensarling, R-Texas, said that the bipartisan debt supercommittee is "somewhat stymied for the moment" because panel Dems are insisting on tax increases of up to $1T in exchange for cost curbs on rapidly spiraling benefit programs such as Medicare & Social Security.  Whopper deficits are an enormous problem & when it domes to solving the problem, this committee is stuck in the mud.

AMR, parent of American Airlines, stock fell near an 8-year-low as American Airlines pushed union workers to accept contracts that would boost productivity.  Compromise is possible if the pilots accept that it will become a smaller carrier.  American tried to wrap up a contract with pilots this week by making an offer with 2 options but union leaders balked, leaving the talks in limbo.  A deal with the pilots' union could establish a precedent for deals with flight attendants & mechanics, who are represented by separate unions.  But leaders of the 3 unions are angry about what they see as overly generous executive compensation while workers continue to labor under wage & benefit cuts they accepted in 2003.  The stock fell today, taking it below $2. If the airline fails, the entire economy will fell its effects.

Enbridge Inc (ENB), a prominent Canadian energy company & the general partner for Enbridge Enrergy Parts (EEP), said it would use its pending $1.2B acquisition of ConocoPhillips’ (COP) 50% stake of the Seaway Crude Pipeline System to clear up a bottleneck of oil in the Midwest.  It will reverse the flow of the pipeline with 50% Seaway pipeline owner & operator Enterprise Product Partners (EPD) to ship oil to export terminals on the US Gulf Coast.  The move would draw down crude backed up at Cushing, Okla, a primary pipeline hub that also serves as the delivery point for oil futures traded in NY.  This news helped send oil futures up more than 3% to $102 on the prospects for lower supplies at Cushing.  Shares of the 3 energy companies were little changed.  The graph below is for ENB, the Canadian energy giant traded on NYSE.

Warnings about the impact of Europe's debt crisis on the global economy brought on selling, especially in the last hour,  Optimism about the US economy limited losses earlier, but bulls went home early.  The exposure banks have to European sovereign debts is unclear & there are fears losses could be substantial.  Banks are cutting jobs with Citi (C) saying it may cut 3K (adding to already high unemployment totals).  Dow could not hold 12K which it has remained near for the last month.  The last time it rose thru 12K, was last Dec when all those smart guys were busy revising upward their projections for 2011.  Hmmm!  Between deficit issues in Europe & the US, the stock market will be challenged.

Oversold market rallies in the last hour

Stocks had been lower all day, but shot up at day's end.  Dow exploded to finish up 153 (but still just below the Aug 8 closing low), advancers ahead of decliners 4-3 & NAZ gained 68 (helped by Apple paring earlier losses).  Financials led the way higher with a solid gain for the Financial Index.

The MLP index had an unusually wild day, bouncing nicely off the 316 low made in May to finish near break even, while the REIT index rose 8+ to the 202s.  Junk bond funds fell 5% closing near the lows, don't see that too often, while Treasuries were little changed, helped by the flight to safety.  Oil continues weak on worries about an economic downturn.   Gold has been hard to figure out.  It should have benefited from being the ultimate safe haven investment, but it looks like overbought has been a greater negative influence.

Apple Debuts IPhone 4S With Faster Chip

Apple introduced a new iPhone, but may have left some fans wishing for more than an updated version of last year's smartphone.  CEO Tim Cook hosted his first major product launch with aplomb, standing in for ailing co-founder Steve Jobs.  The new iPhone is faster, souped-up & comes with voice recognition & a better camera as expected, but did little to lift the bar for smartphones.  Investors & AAPL fans, who were looking to be blown away by some amazing new surprise, sold the stock.  This comes at a critical juncture as Android phones by Samsung & other competitors close in on the iPhone lead.  Android phones dominate the US market 3 years after Google introduced the software.  AAPL must sustain the popularity of iPhone 4, which is more than a year old (selling more 20M units in its Q3).  The company also claims inroads into a corp market dominated by Research in Motion (RIMM) with more than 90% of Fortune 500 companies testing or using its iPhones & iPads.  AAPL was down only 2 (18 above its lows of the day).

Ben Bernanke said the economic recovery "is close to faltering" & the central bank is prepared to take further steps to support it.  He said the economy is growing more slowly than the Federal Reserve (FED) had expected.  The biggest factor depressing consumer confidence is poor job growth.  "We need to make sure that the recovery continues and doesn't drop back and that the unemployment rate continues to fall downward," Bernanke said.  Markets had risen after he had previously hinted at a QE3, then markets fell back.  Bernanke offered his grim assessment after the economy barely grew in H1 & it created no net jobs in Aug.  Consumer confidence fell this summer to the lowest point since the recession.  Europe's debt crisis has also intensified.  After their Sep meeting, FED policymakers warned of significant downside risks to the economic outlook.  As a result, the FED voted to shift $400B of its portfolio from short- to longer-term Treasurys to try to drive down long-term rates.  The economic picture remains glum.

The VIX, volatility index, has gone thru a lot this year.  It soared in May on increased fears as the market sold off.  Since then it has had a choppy time of it, remaining near 40 (far above its previous levels in the teens).  Today the volatile VIX fell 4+ to just under 41.

The decline for the popular averages brought them to a 20% decline from their recent highs, one signal of a bear market.  Buyers returned with a vengeance in the last hour on reports that European officials were working on a plan to prop up the region's struggling banks.  At its lows, Dow had dropped 800 in 4 days.  It was entitled to a rally, bargain hunters are still around.  No matter what comes of the rumors, fundamental banking problems have not vanished.
