Markets keep drifting, awaiting Greek bailout II

Dow inched up 6 (staying close to break even all day), advances & declines were about equal but NAZ added 11.  Bank stocks, not knowing what to do, slipped back.

The MLP index was up 1+ to the 398s while the REIT index fell 2 to the 249s (remaining near its yearly highs).   Junk bond funds continue in demand & eked out minor gains while Treasuries pulled back.  Oil capped its longest rally this year as unemployment claims unexpectedly declined & Greek political leaders struck a deal on a package of austerity measures.  Gold was flat on mixed signals coming from Europe.

U.S. Mortgage Servicers in $26B Settlement

5 mega banks reached a $25B settlement with 49 states & the federal gov to end a probe of abusive foreclosure practices stemming from the collapse of the housing bubble.   The agreement includes a $1.5B payment to 750K borrowers who lost their homes to foreclosure.  About $17B will pay for mortgage debt forgiveness, forbearance, short sales & other assistance to homeowners.  These banks will also provide $3B in refinancings to lower homeowners’ interest rates.  Bank of America (BAC), a Dow stock, has committed up to $11.8B, including a cash payment of $3.24B,  It is believed that this settlement will allow the banks to speed up foreclosures.  The banks were a little lower on the news.

Facebook's (FB ) privately traded shares have risen 10% since it filed for an IPO, pushing its market value past $100B.  SharesPost managed the auction of 150K shares of Facebook’s Class B stock at a price of $44, compared with $40 one week ago which values Facebook at $102B based on an estimated 2.33B shares.  By way of comparison, Coca-Cola (KO which is 126 years old, a Dow stock & Dividend Aristocrat) has a market cap of $164B.  At $100B, Facebook would be valued at 27 times trailing 12-month sales, compared to about 4X for KO.   FB revenue jumped 88% last year to $3.7B, while net income climbed by about 65% to $1B.  That beats KO, you take your pick!

More than 2 years after the Greek debt mess began, it may finally have begun its long & painful road to recovery.  The political leaders just struck a deal to make deep cuts in gov jobs & spending to help save the country from a default.  But the deal, under negotiation since Jul, is only one of 2 critical steps Greece must take to receive a €130B ($170B) bailout.  It was will be scrutinized during talks in Brussels among finance ministers from the 17 countries that use the €.  The German Finance Minister said no final agreement unleashing the bailout money would be reached today & added more work had to be done to fulfill the conditions for a bailout.  In addition, Greece is close to an agreement with private investors, who hold nearly 2/3 of its debt, to sharply reduce the country's borrowing costs.  The Greek drama drags on (& on & on etc.).

Traders have no idea where to place bets, so markets continue to be adrift.  Reason & clever analysis mean little.  Next week intl biggies will decide if Greece gets bailout II.  By then the negotiations about refinancing the debt with the bondholders should be finalized.  There is a bigger unknown, relating how the Greek population accepts drastic funding cuts.  Barring a major news development, tomorrow should see more sideways trading in low volume markets.

Stock markets rally on fading Eurozone debt worries

Dow rose 186 closing at its highs, advancers over decliners almost 3-1 & NAZ gained 34.  Banks had another good day, but the Financial Index is only 12 above its recent lows.

The MLP Index had a good day but has not been able to get far away from the 350 level (10% below its peak earlier in 2011).  The REIT index gained 3 to the 224s but junk bond funds were mixed to lower.  Treasuries sold off on easing European debt worries.  Oil rose on hopes that an improved European situation will lead to more demand.  Gold fell sharply after 5 top central banks made a joint offer to support European banks to ease worries about the region's debt crisis.

Default notices sent to delinquent homeowners surged 33% in Aug from Jul, a sign that lenders are speeding up the foreclosure process after almost a year of delay.  First-time defaults were filed on 79K properties, the most in 9 months according to RealtyTrac.  Total foreclosure filings, which also include auction & home-seizure notices, increased 7% from a 4-year low in Jul to 228K.  One in 570 homes received a notice during Aug.  However on a year-over-year basis, foreclosure filings dropped for an 11th straight month after claims of “robo-signing,” or pushing through documents that weren’t verified, spurred an investigation by state attorneys general in Oct.  The jump in default notices from Jul, the biggest gain in 4 years, shows that bank paperwork delays are easing.  Total filings in Aug dropped 33% from a year earlier.  Default notices fell 18%, while scheduled auctions slid 43% from Aug 2010 & 1% from Jul.  Lenders seized 65K properties in Aug, a 4% decline from the previous month & a 32% slump from a year earlier.  The jump in default notices means repossessions probably will increase in coming months as more foreclosures are processed.  This gloomy news is a key factor explaining why the economic recovery has stalled.

Netflix Tumbles After Cutting Forecast for U.S. Subscribers

Netflix lowered its expectations for US subscribers in Q3 by 4%, just weeks after separating its DVD & streaming services, which increased the price for customers who want both.  The company, which split its streaming & DVD-by-mail services 2 months ago, now expects 24M subscribers in Q3, down from the 25M it forecast in Jul.  It expects 21.8M to subscribe to its streaming service, either with or without also getting DVDs in the mail, down from an expected 22M it forecast earlier.  And Netflix expects 14.2M to subscribe to mail-order DVD rental service, with or without streaming, down from its Jul forecast of 15M.  NFLX kept its forecast for intl subscribers, which makes up a small fraction of its total customers, & overall Q3 earnings intact.  This had been one of the hottest stock in recent years, but no more.  The stock plunged $39.46 today (19%) to $169.25.

The Treasury Dept inspector general opened an investigation of a $528M gov loan to Solyndra, the now-bankrupt solar panel manufacturer once cited as a model of the Obama administration's clean energy program.  The inspector general is reviewing the role & actions of the Federal Financing Bank, a gov corp supervised by the Treasury Dep, because it provided a low-interest loan to Solyndra.  The Treasury investigation is the latest gov inquiry into the collapse of Solyndra.  The FBI has executed search warrants at Solyndra's headquarters (shown in the picture) & talked to top executives.  The Energy Dept inspector general & the House Energy & Commerce Committee also are investigating Solyndra & the DOE's Energy Loan Program, which has provided $B in loan guarantees to renewable energy companies. The loan loss will come from the stimulus money, the bill which had to be passed in a rush because it was soooo important to the economic recovery!!

Stocks are having a great week.  Dow is up 500, what else is there to say?  Major central banks seem to have solved European debt problems, at least for the time being.  Keep in mind, there were protests in Greece & Italy, austerity is not going down well with the local populations.  Then there is the problem of fixing the massive deficits in the US.  The fights have barely begun on that one.  Business leaders are cautious about investing in the future with the uncertainty coming from DC.  The VIX, volatility index, is down to 32, but it remains high relative to the mid teens where it had been during better periods in the markets.  This week, investors are happy.  Tomorrow will take care of itself.

Markets rise on optimism about global recovery

Stocks exploded out of the gate, remaining higher until profit taking in the latter part of the session.  Dow added 75 & is looking to top its 11.2K high for 2010, advancers ahead of decliners almost 4-1 & NAZ added 23.  Bank stocks lost their early gains bringing the Financial Index back to even.

The Alerian MLP Index rose 2+ to the 351s, setting another new record (like gold & Apple).  The Dow Jones REIT Index shot up 3+ to 200, a new yearly high although still down 30% from its record highs 3 years ago.  Junk bond funds were up to new interim highs while Treasuries settled back but not too much.  The yield on the 10 year Treasury bond was up only 1 basis point to 2.43%.

Oil rose for the first time in 3 days as China reported record crude imports in Sep, & the International Energy Agency raised its global demand forecast. If the global economy is improving, the idea is everybody will consume more including gold.  Gold bulls now have 1400 in sight after breaking thru 1300 just 2 weeks ago.

50 states & the District of Columbia have launched a joint investigation into allegations that mortgage companies mishandled documents & broke laws in foreclosing on thousands of homeowners.  They will examine whether mortgage companies made false statements or prepared documents improperly.  This has become a nationwide scandal that's called into question the accuracy & legitimacy of documents that lenders relied on to evict people from the homes. Employees of 4 large lenders have acknowledged in depositions that they signed off on foreclosure documents without reading them!  The allegations raise the possibility that foreclosure proceedings nationwide could be subject to legal challenge & some could be overturned. More than 2½M homes have been lost to foreclosure since the recession started in Dec 2007.

Apple (AAPL), with the 2nd largest market cap in the world, set another record, up 1½ to close at 300.  AAPL plans to hold a 'Mac Event' next Wed that will include a preview of the next version of the Mac operating system according to CNBC.  Some are calling for targets above 400.  OK, but I've heard that kind of talk before.  The chart shows its record thru the recession & fabulous run in the last year.

Dow is challenging its yearly peak.  The reception of earnings reports will drive it to new heights or not.  The foreclosure mess is growing day by day & that could be a major obstacle for banks which are supposed to be market leaders.  JPMorgan (JPM) lost 56¢ after its earnings report which got only so-so reviews after reflection.  With midterm elections approaching, politicos will be eager to jump all over lenders.  I see this dark cloud overhead getting much darker.

Markets lower ahead of earnings announcements

Stocks opened weaker but have recovered some of the early losses.  Dow is down 34 to 10,974, decliners ahead of advancers almost 2-1 but NAZ added 2.  Bank stocks inched up taking the Financial Index higher.

The Alerian MLP Index is catching its breath after gaining almost every day since the start of Sep.  Today it fell 1 to the 348s, no big deal.  The REIT index was flat in the 216s while junk bond funds were mixed at or very near their highest levels in 2 years.  Treasuries keep climbing on expectations that the Federal Reserve will purchase more bonds.  Unfortunately small business owners say money is available, their biggest problem is a lack of sales growth.  The yield on the 10-year Treasury bond fell 1 basis point to 2.37%, nearing its record lows of about 2.1% at the start of last year.

Oil fell because of the stronger dollar, but at 80+ it remains in the upper end of its trading range for the last 2 years. Gold is resting after climbing to new record heights.

Temporary pauses in foreclosures have expanded among major lenders with greater concerns about sloppy paperwork to support evictions of delinquent borrowers.  Worries increase that a blanket ban on foreclosures could further hobble the economy, even making it "catastrophic."  Dramatic nationwide action could unjustly impose losses on investors in the housing market.  Investors who buy mortgage-backed securities free up money that can be used by lenders to make new loans.  The market for mortgages nearly dried up during the height of the 2007-2009 financial crisis but the instruments have rallied since Mar 2009 as investors bet depressed prices more than account for losses that will come as homes backing bad loans are liquidated.  Bank of America (BAC), the nation's largest mortgage servicer & a Dow stock, said on Fri it would temporarily halt foreclosures nationwide as it reviews its foreclosure processes.  JPMorgan (JPM), another Dow stock, & Ally Financial (GMAC Mortgage) have announced partial moratoriums, but some other leading mortgage servicers have said they have no plans for a systematic halt.



Pfizer (PFE), a Dow stock, will acquire King Pharmaceuticals (KG), a diversified specialty pharmaceutical discovery & clinical development company, for $3.6B in cash ($14.25 per share, representing a premium of 40% to King's previous closing price).  The transaction was approved by both boards & is expected to be accretive to PFE adjusted diluted earnings per share by approximately annually in 2011 & 2012, then 3-4¢ annually from 2013-2015. KG jumped 4 to 14.15 while PFE lost a couple of pennies.

Little is happening in the markets but there is a lot of nervousness.  Intel (INTC), a Dow stock, reports earnings after the close.  The stock is flat.  The foreclosure mess is growing, not a good sign for the markets.
